Anyone who has been charged with a criminal offense is facing the prospect of potential incarceration, fines or both. Criminal offenses are divided into 3 categories – summary offenses, misdemeanor offenses and felony offenses. Felonies are the most serious and can be punishible by up to 20 years or more in prison. Misdemeanors, such as DUI, drug possession and theft, can be punishible by up to 5 years in prison and summary offenses, such as disorderly conduct and harassment, are typically punishible by up to 90 days in prison. However, with regard to DUI offenses, it is important to keep in mind that most include either a license suspension, mandatory time in prison or both.

If you have been convicted of a crime, including DUI, and have been sentenced, you have the right to appeal your conviction to the Superior Court. However, there are very strict time constraints for you to file an appeal – typically 30 days from the date you are sentenced.
